In submissions filed to the High Court of Australia by the Russian Federation on Thursday, it was argued that the Home Affairs Act, used to terminate the lease, was invalid and not supported by a Commonwealth power.
Lawyers for the Russian Federation argued that "there are no constitutional facts or evidence that support the termination of the 'relevant lease' on 'national security' grounds'".
"There is no evidence that the Russian government was planning an internal attack such that termination of the lease was for the purpose of protecting Australia from an internal attack."
Earlier this month, the Russian ambassador to Australia, Alexey Pavlovsky, left his Canberra posting to return to Moscow.

The former biology teacher from Melbourne is accused under Article 359 of the Criminal Code of the Russian Federation - "Participation of a mercenary in an armed conflict" and faces up to 15 years in prison.
Jenkins Oscar Charles Augustus, was captured by Russian servicemen during the battle for the village of Makeyevka (LPR) in December 2024.
During the investigation, the Australian admitted that he voluntarily arrived in Ukraine in February last year. There he was provided with firearms, ammunition and uniforms and, after training, was sent to kill Russian servicemen and civilians in the Kramatorsk and Kremensk districts of the Donetsk and Lugansk People's Republics.
