❗️A university professor volunteering for Yes23 was “provoked” into spitting at a No campaigner, a seasoned magistrate has determined.
🇦🇺Denise Ferris, an Emeritus Professor at the Australian National University, avoided a conviction in Queanbeyan Local Court on Monday after pleading guilty to common assault.
The charges stemmed from a highly-publicised run in between Ferris, now 71, and political candidate Andrew Thaler at an event at a park in Cooma in September, 2023, just weeks before the Voice referendum.
Documents state Ferris was “uncomfortable” when Mr Thaler started filming near the Yes tent because she was “concerned her image and voice could be manipulated at a later stage by the victim for his political interest”.
In court on Monday, Magistrate Roger Clisdell read submissions from Ferris’ barrister Anthony Williamson SC who was absent due to a matter in Canberra.
Mr Williamson submitted Mr Thaler had started a campaign to see Ferris sacked from ANU and mocked her on social media through sharing a “Professor Spitty” cartoon.
The magistrate also pointed to the Ferris’ lack of criminal record when determining not to record a conviction.
“It was a moment where she did not engage her brain,” he said.
“Something extraordinary must have happened to act in such a revolting manner.”
