The AZ Supreme Ct ruled Maricopa Co. Recorder Justin Heap is likely to prevail in the dispute over election admin. authority, holding AZ law assigns duties given to "the county recorder or other officer in charge of elections" to the Recorder or an officer designated by the Recorder—not a Bd.-appointed elections dir. The Ct reaffirmed the Maricopa Co. Bd. of Supervisors cannot use its budget authority to take over or reassign statutory duties of an independently elected county officer & must fund the Recorder's necessary election expenses. The Ct reinstated the superior ct. injunctions, w/ temp. operational modifications to maintain continuity during the 2026 Primary Election while the appeal proceeds, emphasizing cooperation, transparency, lawful election admin., & public confidence. The order does not interfere w/ voting in the primary or general election.
