AG Brnovich Denies Senator Townsend’s 1487 Request - Says the Investigation Needs to Be More Thorough Than Allowed by 1487
“Given that the Office has already received a referral, and given that the investigation involved will be highly factual, an SB 1487 investigation is an inappropriate vehicle to enable the Office to thoroughly investigate the issues contained in the reports. Notably, A.R.S. 41-194.01 provides no opportunity for the Office to take factual discovery and provides only a limited 30-day window for the Office to issue a legal report.”
Brnovich goes on to say that the 1487 process could “seriously hamper” the investigation and his Office will be acting under the authority of A.R.S. 16-1021.

Senator Townsend Responds to Brnovich
Here is the statute for the Legislators' 1487 complaint to the AZ Attorney General. 'Shall' is not discretionary. 'Investigate' means go and embark on factual discovery. I don't see a provision in there that allows him to say no, do you General Brnovich?
Also, my 1487 complaint to General Brnovich included multiple questions not raised by the Senate final audit report. They are separate Q's that legally must be answered. I will not accept nonfeasance for an answer.

AG Brnovich knows three things:
1.) without Trump’s endorsement, no one is going to vote for him.
2.) he doesn’t get that endorsement unless he ruthlessly goes after election fraud.
3.) he cant win unless he goes after election fraud because they’ll steal it from him just like they did from Martha McSally.

The letter to Maricopa county to preserve all records is a sign the criminal case is already open.

I spoke with Senate President Karen Fann about the routers and the splunk logs. She says that the lawyers are working with Shadegg on the selection of IT experts and that Cyber Ninjas (Doug Logan) & Cyfir (Ben Cotton) are involved. Doug and Ben are currently preparing the documents with all of the data they need. I will keep you all updated with info as I get it.

Push to reverse Arizona election reform laws fails to make ballot
Petitioners couldn’t collect the required signatures to put questions on the 2022 general election ballot to reverse three laws.
Fann Denies Agreement with Maricopa County Made “to Water Down Results” of 2020 General Election Audit | AZ Daily Independent
AZ Senate President Karen Fann’s settlement agreement with Maricopa county over the withheld router and Splunk log data has been widely criticized by the grassroots. We highlighted some of the concerning aspects of the contract in a September 17 post.
In an email yesterday, Fann attempted to respond to the objections and addressed next steps regarding election nullification. The following are excerpts from her statement:
“We are introducing bills to make sure election integrity is the utmost priority. The AG’s job is to enforce those laws and determine if laws were broken, whether intentionally or fraudulently. With a full investigation, he has the authority to order depositions, canvass voters, and compel Maricopa County to comply in producing everything he requires to hold people accountable. Some of the information in the audit report showing abnormal vote counts is labeled “incomplete” since additional information was still needed to absolutely confirm their findings. The AG will be able to obtain this missing information to complete and confirm those large discrepancies.
Many of you have written demanding the Senate to decertify the electors which is something we cannot do according to our constitution. Should the courts find malfeasance in the 2020 elections to a degree it could change the outcome of the winners, we can offer legislation to correct the official vote counts and ask the courts to declare those specific races invalid. Passing this legislation would require 31 votes in the House chamber and 16 votes in the Senate chamber. (The 31 and 16 still holds true even with the unfilled seats) At this time we do not have the required votes to even hold the Board of Supervisors in contempt for not complying with our subpoenas.
In response to the questions or concerns about the agreement on the routers. …Maricopa County contacted us and asked if we would be interested in a settlement to the 1497 claim in lieu of them filing a lawsuit preventing the auditors to physically have the routers. We believe the judge would have ordered this same compromise after we endured more endless delays in obtaining the information needed. …There will be IT experts/firms hired who will do the physical extrapolation of the data the auditors need. We are working out the details of how that would work, who would do this work, and the format to ensure we have absolute proof and confidence in their work. The Senate did not give up any of our rights to continue pursuing the truth or additional data needed in the future. We still hold the right to issue new subpoenas at any time.”
