Senator Kelly Townsend Update on SB1819 — Amendment for Federal-Only Voters Passed

I am pleased that my amendment to SB1819 was adopted and passed, having to do with cleaning up the Federal-only voter issue. Please see the fact sheet info below:

1. Requires the Secretary of State (SOS) to provide access to the statewide voter registration database to a person or entity that is designated by the Legislature and to the Election Integrity Unit of the Attorney General's (AG's) Office for the purpose of determining whether the SOS's voter registration list maintenance procedures comply with federal law with respect to voters who are registered as eligible to vote only for federal offices (federal-only voters).

2. Requires the person or entity designated by the Legislature to be qualified in more than one state to analyze a state's voter registration rolls for compliance with federal law regarding voter registration list maintenance procedures.

3. Requires the person or entity, after completing its analysis, to report its findings to the Legislature, AG and SOS.

4. Requires the SOS, if the analysis determines that there are person registered to vote who are not eligible to register to vote, to notify the appropriate county recorder and requires county recorders to remove those persons from the voter registration rolls.

5. Requires each county recorder to submit an annual report to the Legislature that contains the following regarding federal-only voters: a) a description of the county recorder's procedures regarding registering federal-only voters; b) the number of federal-only voters in the county; c) the number of voters whose citizenship has been otherwise subsequently verified and whose status has changed to voters who are eligible to vote a full ballot; d) a comprehensive description of the obstacles to obtaining voter registrants' documentary proof of citizenship that complies with Arizona's voter registration requirements and to changing their status to voters who are eligible to vote a full ballot; and e) the number of voters who have been subsequently determined to be ineligible to vote in Arizona and who have been removed from the voter registration rolls.

6. Requires the AG and county attorney to investigate and prosecute, as appropriate, any person who knowingly registers to vote despite being ineligible.

7. Requires the SOS, by December 31, 2021 and pursuant to the National Voter Registration Act of 1993, to submit a request to the U.S. Election Assistance Commission that the Commission include Arizona's state-specific instructions to provide proof of citizenship on the federal voter registration form.

Good news! RINO Governor Doug Ducey of Arizona has restated the fact that he is not running for the United States Senate. It would not matter, however, because he could not get the nomination after failing to perform on the Voter Fraud in Arizona. Also, there is no way he would get my endorsement, which means, his aspirations would be permanently put to rest anyway. Again, thank you to our brave Republicans in the Arizona State Senate for their bravery in putting forward the Forensic Audit. Everybody is anxiously awaiting the result!
Senator Kelly Townsend’s Request to Audit the Zuckerbucks Grant Money and Maricopa County’s Dodgy Dominion Procurement Process is Adopted into the Budget

I am pleased that my request to audit the "Facebook money" that went to our elections was approved and adopted into the budget. Please see the verbiage below:

Audit of Private Money Accepted to Run Elections

The auditor general shall conduct a special audit of financial and related information of any private, nongovernmental grant monies used for this state's 2020 elections and Maricopa county's procurement of voting systems. On or before March 31, 2022, the auditor general shall submit a report to the governor, the president of the senate and the speaker of the house of representatives on all of the following:

1. Private, nongovernmental grant monies received and expended by the secretary of state's office for the 2020 elections and any balance remaining unexpended on June 30, 2021, for the following:

(a) Educating voters how to sign up for the permanent early voting list or how to request an early ballot. The report shall include the type of information provided and where the information was provided.
(b) Recruiting poll workers. The report shall include where the recruitment was targeted and advertised and the requirements for poll worker selection.
(c) Combating misinformation and disinformation about the 2020 elections. The report shall include the methods used, the type of information provided and where the information was provided.
(d) Personnel and employee-related expenses. The report shall include an analysis of why the monies were used for these specific purposes.

2. Private, nongovernmental grant monies received and expended by Maricopa county on programs and processes for the 2020 elections, including the purpose of the expenditures, the amount spent for personnel and employee-related expenses and any balance remaining unexpended on June 30, 2021.

3. Private, nongovernmental grant monies received and expended by Pima county on programs and processes for the 2020 elections, including the purpose of the expenditures, the amount spent for personnel and employee-related expenses and any balance remaining unexpended on June 30, 2021.

4. Maricopa county's process to acquire Dominion Voting Systems, including information regarding:

(a) Compliance with the county's procurement code.
(b) Agreement terms, including acquisition costs, time frames and machine maintenance and security.
(c) The Maricopa county board of supervisors meetings to discuss the acquisition, including any public comment.
(d) The security and technical analysis that occurred before the acquisition.

Ken Bennett strongly urges the AZ Legislature to stay in session: “Personally, I hope they seriously consider recessing for 5-6 weeks instead of adjourning until next January.” Senate President Karen Fann and Speaker of the House Rusty Bowers could call a recess without requiring a vote. The final audit report is expected to be released to the Senate in August and Ken told OAN, “I hope they are in session to receive it.”

A Recap in the Last Days of the Arizona Audit: Mainstream Media Meddling and ‘Blue Pen Jen’

Randy Pullen, a former chairman of Arizona’s GOP serving as a volunteer consultant to the Arizona Senate, sat down in an interview at the audit site with The Sun Times to discuss their months of work. He shared that they would likely be finished by Saturday. Pullen said that they’ve averaged over 125,000 ballots a day at this point.

Pullen shared that it’s taken their workers a while due to the inconsistencies in the ballot batches. With each inconsistency, the workers must flag the legal counsel and officials to document the issue.

“Originally, what the counties said was that each batch was in plastic bags. Then, [we] discovered that each batch has only pink sheets [batch sheets] between them. Or, the pink sheets are stacked together on top of all the ballots. Those [ballots] are counted, but there’s no identifiable way to determine which batch they are a part of,” said Pullen. “Everything is legally documented. If everything is perfect, then there’s no problem. But here’s what happens: the batch sheet says there are 200 [ballots] but there’s only 190. Then legal counsel has to document that there’s only 190.”

When asked when the company in charge of the audit, Cyber Ninjas, would finish their analysis, Pullen estimated the end of July at the earliest. The only problem, he said, concerns the tabulating machines and routers. Auditors don’t have access to those yet because election officials won’t turn them over. Pullen said that this presented an issue – especially because election officials reportedly lack the passwords to the tabulators.

🚨TAKE THE AZ LEG SINE DIE SURVEY 🔗

The Arizona Legislature is expected to Sine Die (official end of the session) shortly after the budget is completed because a super Majority of Dems and Republicans support ending the session.

Sine Die will cause all legislation not passed to die. We will possibly remain in an emergency unless Gov. Ducey ends it (this is being negotiated and explored by the Governor per insider sources).

Sine Die will also put the audit at additional risk for shenanigans because the Senate will not be in session to hold a contempt vote. Although, Sen. Boyer has affirmed he will vote no on contempt votes.

Within the budget is an arrangement to hold a joint election committee to review the findings of the election audit with the suggestion to ask Gov. Ducey to call a special session to pass additional election integrity bills. There is no requirement for the Governor to comply.

Hoffman] to put watermarks on ballots, investigate whether Twitter and Facebook banning people is an unreported in-kind political contribution, and make county recorders document voter registration outreach.

Sen. Navarrete was almost at a loss for words in explaining his opposition to the [@JakeHoffman] amendment: ‘We have to stop this today. We can't continue living in an environment where we are constantly undermining our bipartisan county recorders and the secretary of state.’”

Arizona Senate overrides a governor's veto for first time in 40 years

PHOENIX — State senators did something Thursday they haven't done in four decades: voted to override a gubernatorial veto and set the stage for the House to do the same.

And now they're hoping that Republican Gov. Doug Ducey doesn't retaliate.

The 25-5 vote came on one of the 22 bills that Ducey vetoed a month ago because he was upset that the Republican-controlled Legislature had failed to send him a state budget. The Senate needed just 20 to get the required two-thirds vote for the override.

Senators also voted on Thursday to repass new versions of 21 of the measures and send them back to the governor.

@KellyTownsend commented: The Governor's response was surprisingly gracious. I am impressed.

🚨 AZ STATE BUDGET & ELECTION INTEGRITY UPDATE 🚨

It’s was a heckuva day down here at the AZ Capitol yesterday! I arrived at ~8:15am and pulled out of the parking lot to head home at ~10:45pm.

The budget is about 85% done so we start again today at 9:00am for another 5-6 hours of debate.

The GREAT news is that yesterday we took the final vote to pass the HISTORIC $1.9 BILLION TAX CUT, including establishing a 2.5% flat tax and a 4.5% max income tax cap!

THIS IS A HUGE WIN FOR ALL TAXPAYERS, SMALL BUSINESS OWNERS, & JOB CREATORS!

Arizonans were slammed last year (and continue to be) by one of the worst economic disruptions in over 100 years due to the Chinese coronavirus. Despite the hard times YOU experienced the state of AZ is sitting on RECORD revenues. Having a multi-billion dollar surplus is not something to celebrate. It means we’re OVERTAXING our citizens.

Thanks to the work of Republicans in the legislature yesterday, we cut taxes in a BIG way letting AZ taxpayers keep BILLIONS more of their own money!

Last night we also passed my election integrity amendment that created an Election Integrity Fund and appropriated an initial $12 MILLION to be used for things like:

▪️Anti-fraud ballot security paper
▪️Election security measures
▪️Election cybersecurity measures
▪️Post-election hand count tabulation

Also in the election integrity amendment was the creation of an Unreported In-Kind Contribution Task Force to investigate big tech bias and their attempts to influence our elections.

These are two HUGE victories for the people of Arizona and will help ensure voters can have confidence in the process and outcome of Arizona elections.

There were other great things that we did yesterday that I’ll share in the coming days, but right now we can all celebrate these incredible victories for the people of Arizona!

AZ Audit Update: Paper Analysis COMPLETED – Team Vacating Coliseum – What’s Next!?

It appears that the Arizona audit has finally finished with the paper evaluation phase — they are now removing tables from the floor. Volunteers slammed a box closed and everyone cheered in celebration. We believe this was the last box.

The audit team is still lacking the subpoenaed routers, logs and passwords, so litigation is expected in order to obtain that information. They will need this information to complete the full forensic audit. Legislative subpoenas for this data were issued on January 13, 2021.

Christina Bobb reported on One America News that she anticipates the results will be released in two phases. On Monday we may see a preliminary report, which details the accuracy of the number of certified ballots. [The release of initial ballot count findings has not been confirmed by the audit team or the Senate.]

Sometime in August, we should expect to see the full forensic report. At that point, we will know if Attorney General Brnovich needs to get involved to pursue an investigation.

🚨 ARIZONA ELECTION INTEGRITY & EDUCATION UPDATE 🚨

Another long day at the AZ Capitol yesterday, but Republicans in the House accomplished exceptional things on behalf of the people of this state! I’ll break them up into three categories: Election Integrity, Education, & Critical Race Theory.

ELECTION INTEGRITY

Approximately 3 weeks ago Governor Ducey vetoed my election integrity legislation that would ban the mass mailing of ballots to voters that didn’t request an early ballot. The legislation also added a Class 5 Felony for County Recorders who go rogue and willfully violate this law.

Undeterred by the veto, I reintroduced my legislation as a new bill and yesterday the House once again passed this critically necessary election integrity reform.

HB2905 (banning mass mailing of ballots) now heads to the Senate for a vote! Please let all Senate Republicans know how important it is that they pass HB2905 and send it back to the Governor!

EDUCATION

Yesterday, conservatives in the House added some incredible provisions to the K-12 bill. Take a look!

◼️ Require K-12 schools to teach:

▪️about the evils of communism and totalitarianism

▪️about the original intent of the founding documents and principles of the United States (from the actual source documents)

▪️first-hand accounts of people who escaped communist and totalitarian governments and now enjoy the blessings of freedom and liberty in America

A huge shoutout goes to Representative Judy Burges for bringing this idea to the House!

◼️ Total ban on masks and vaccine mandates for K-12 student in-person learning:

▪️School districts will no longer be allowed to mandate face masks or COVID vaccines for in-person learning

A huge shoutout goes to Representative Jacqueline Parker for this!

◼️ Total ban on teaching Critical Race Theory in public schools:

▪️Public schools will no longer be allowed to teach or spend public monies on the instruction of this hateful, racist, anti-American ideology

A huge shoutout goes to Representative John Fillmore for bringing this amendment to fix the CRT language and make it a TOTAL ban!

CRITICAL RACE THEORY

Three weeks ago the Governor also vetoed my legislation banning Critical Race Theory and prohibiting spending public monies on it at ALL levels of government (city, county, state agency, etc).

CRT is being used by leftist politicians and bureaucrats to:

▪️ Undermine and attack our great police officers
▪️ Indoctrinate taxpayer funded public employees
▪️ Institutionalize racism, sexism and bigotry within our local governments and society
▪️ Fundamentally transform our local governments’ worldview
▪️ Encourage the exact kind of racism that America and MLK Jr. fought so hard to stomp out
▪️ Destroy the exceptionalism of the United States

This disgusting ideology is the opposite of what America stands. This legislation is too important to allow it to be vetoed, which is why I have re-introduced it as HB2906 and yesterday Republicans in the House re-passed the bill.

The bill now needs one final vote in the Senate and then will go back to the Governor for his signature.

Please let all Senate Republicans know how important it is that they pass HB2906 and send it back to the Governor!

Yesterday it was every Republican who passed these great pieces of legislation. Not a SINGLE Democrat had the courage to join with Republicans to do the right thing for the people of Arizona. In fact, nearly EVERY Democrat actively fought AGAINST these great things. Democrats called the majority of the House—and by extension the majority of Arizonans—racists, liars, white nationalists and much more as they opposed these measures.

Let their attacks and opposition be a stark reminder:

Elections matter.

I, along with many of my fellow Republicans, am fighting like hell to make sure the voice of the People is not just heard, but is acted on, at the State Capitol!
