اگر گرین کارت دارید و می خواهید از آمریکا خارج شوید، ممکن است جواب بسیاری از سوال هایتان را در همین مطلب بیابید:

🎈بسیاری از دارندگان گرین کارت تصور اشتباهی از وجود قاعده ای مشهور به بازگشت هر 6 ماه یک بار ( Return Every 6 Months Rule) دارند. این افراد تصور می کنند که اگر هر شش ماه یک بار به آمریکا بیایند و در واقع طول اقامتشان در خارج از آمریکا از 180 روز کمتر باشد، هیچ مشکلی برای اقامت دائم آن ها در آمریکا بوجود نمی آید. متاسفانه واقعیت این است که کسانی که از گرین کارت به عنوان ویزای ورود به آمریکا استفاده می کنند و هر 6 ماه یک بار چند هفته ای را در آمریکا می گذرانند، به شدت در معرض خطر ابطال اقامت دائم قرار دارند. این افراد اصطلاحا در وضعیت "touch down " قرار دارند یعنی با فواصل زمانی نزدیک به 6 ماه خود را به آمریکا می رسانند و مدتی به صورت تفریحی و بدون قصد اقامت دائم در آمریکا می مانند.

🎈 اگر ماموران اداره گمرک و محافظت از مرزها ( CBP) که عموم مردم آن ها را به عنوان افسران اداره مهاجرت در فرودگاه می شناسند، تشخیص دهند که فردی در وضعیت touch down است، این وضعیت را در پرونده وی ثبت می کنند. معمولا روال برخورد با این افراد این گونه است:
- معمولا برای بار اول به فرد تذکر داده می شود اما پرونده او به دادگاه ارسال نمی شود.
- اگر فرد نسبت به اصلاح وضعیت خود اقدام نکرده و همچنان آمریکا را محل اقامت دائم خود قرار ندهد، پرونده فرد به دادگاه مهاجرت فرستاده می شود و فرد در معرض اخراج از آمریکا و Romoval Proceedings قرار می گیرد. این بدین معنی است که فرد باید نزد یک قاضی مهاجرتی حاضر شده و قاضی را اقناع کند که اقامت دائم خود را در آمریکا رها نکرده است.

🎈 به خاطر داشته باشید که تنها قاضی مهاجرتی می تواند اقامت دائم فرد را باطل کند و ماموران مستقر در مبادی ورودی (مثلا فرودگاه ها) اختیاری در این زمینه ندارند. بنابراین شایعات و داستان هایی مانند زدن مهر ابطال روی گرین کارت افراد در فرودگاه ها واقعیت ندارد.

🎈ماموران آمریکایی مستقر در فرودگاه های خارجی نمی توانند اقامت دائم شما را ابطال کنند اما می توانند به شرکت هواپیمایی توصیه نمایند که از سوار کردن شما به هواپیما خودداری کند. این خطر در فرودگا هایی که برنامه Immigration Advisory Program (IAP) را با همکاری دولت آمریکا اجرا می کنند جدی تر است. فرودگاه دوحه قطر یکی از اجراکنندگان این برنامه است.

🎈 به خاطر داشته باشید که اقامت های طولانی خارج از آمریکا حتی اگر به قیمت از دست دادن گرین کارتتان تمام نشود، در مرحله درخواست شهروندی (citizenship ) حتما دردسر ساز خواهد شد. اقامت بیش از شش ماه در خارج از آمریکا باعث ایجاد اماره خلاف پذیر از بین رفتن حضور مداوم در آمریکا ( continuity of U.S. residence ) می شود که از شرایط اعطای شهروندی است . به عبارت دولت فرض می کند که شما این شرط را از دست داده اید مگر اینکه بتوانید خلافش را ثابت کنید.
اقامت بیش از یکسال خارج آمریکا حتما شرط تداوم اقامت را از بین می برد و خلاف آن هم قابل اثبات نیست.

🎈 اقامت بیش از یک سال خارج از آمریکا باعث می شود که شما حق استفاده از گرین کارتتان را به عنوان مجوز ورود به آمریکا از دست بدهید. یعنی اگر بیش از یک سال خارج از آمریکا بمانید، برای بازگشت به آمریکا باید درخواست ویزا نمایید. برای در امان ماندن از این مشکل می توانید با پر کردن فرم I-131 درخواست صدور re_entry permit داشته باشید که به شما اجازه می دهد تا 2 سال ار تاریخ صدور بدون نیاز به ویزا با همان گرین کارت وارد آمریکا شوید.

🎈 فراموش نکنید که حتی اگر re-entry permit هم داشته باشید، اگر ماموران مستقر در مبادی ورودی احساس کنند که شما اقامت خود را رها کرده اید، باز هم می توانند شما را در removal proceedings قرار دهند. به عبارت دیگر، کارکرد re-entry permit فقط حفظ حق ورود شما به آمریکا با گرین کارت است و شما همچنان موظف هستید ترتیباتی اتخاذ کنید که در زمان غیبتتان از آمریکا وابستگی شما به این کشور قطع نشود.

🎈مام افراد بالای 18 سالی که متقاضی re-entry permit هستند باید انگشت نگاری شوند. معمولا بهتر است تا دریافت permit صبر کنید اما اگر برای خروج از آمریکا عجله دارید می توانید بعد از انگشت نگاری آمریکا را ترک کنید.
👈دستور اخیر رئیس جمهور ترامپ تاثیری بر موارد فوق و به طور کلی وضعیت دارندگان گرین کارت ندارد.
