If they think they have a case beyond a reasonable doubt, the only way I see that happeneing is either he emailed with others about the phrase, or FBI went back to where he claimed to take the picture, found the rocks still sitting there, took them to the crime lab, and found DNA, which means Comey had to move them into that position.
