Technically it is inconclusive, but apparently ATF had enough jacket they felt they could match it before saying they could not. So they have a bullet consistent with a 30-06 cartridge, which failed to penetrate the neck fully, and which cannot be linked to this rifle. I would hypothesize somebody near Charlie with an old Tokarov or a zip-gun made of a pipe up his sleeve, or something, loaded with a cartridge topped with a 30 cal rifle bullet, fired the shot, but that would require they be an absolute perfect pistol shot to guarantee a killshot with a pistol firing a bullet that its rifling and size is not designed to.
