National Emergency:
As per Article 352 of the Indian Constitution, the President of India may declare a national emergency if the security of India or any part of it is threatened due to war, external aggression, or armed rebellion.
The use of the term 'armed rebellion' is notable: it was added by the 44th Amendment Act, 1978, which replaced the initial term 'internal disturbance'. Hence statement 1 is correct.
Under normal circumstances, India follows a federal structure. However, when a National Emergency is declared under Article 352, it gives rise to a kind of 'legal unitariness' allowing the Central Government to give executive directions to a State on any matter, as underlined in Article 353 of the Indian Constitution. Hence statement 2 is also correct.
A proclamation of the emergency does not automatically lead to the suspension of State legislatures, however, during a national emergency, the Parliament becomes empowered to make laws on any subject mentioned in the State List. Hence statement 3 is correct.
As per Article 352(8) of the Indian Constitution, a national emergency, after first being proclaimed by the President, must be approved by the Parliament within one month. Thereafter, subject to continued parliamentary approval, this emergency can be extended indefinitely, but each extension is valid for a maximum of six months at a time
. Hence statement 4 is also correct.
Note:In the original CAPF 2023 question paper option 4 was 2,3 and 4 Only. But since statement 1 is also correct, this would invalidate the question. So, option 4 has been changed.
