SC barred judiciary from using the term ‘child pornography’

why in news ?

The Supreme Court has directed all courts to stop using the term ‘child pornography’ in their orders. It also suggested that Parliament should bring a law to define it in clearer terms

the CJI-led bench said the term, often used in judiciary, media and political discourse, fails to capture the full extent of the crime against children.

the Supreme Court asked to replace the term with “child sexual exploitative and abuse material” (CSEAM) in all judicial orders and judgments.

🌟The court also explained that the term trivialises the gravity of the offence, as pornography is typically associated with consensual acts between adults.


"viewing of child pornographic material on the internet is also an offence under Section 15 of the Protection of Children from Sexual Offences (Pocso) Act and provisions of Information Technology Act, thus considerably expanding the scope of the two laws through purposive interpretation".
