Ultimately, in this specific case, the Supreme Court did not declare the right to marry as an enforceable fundamental right under the Constitution. The majority opinion left the issue of same-sex marriage to the domain of the legislature rather than asserting it as a fundamental right. It's essential to note that the recognition of the right to marry as a fundamental right can vary from one jurisdiction to another and is subject to legal interpretation.
