It does not have the right under international law to take IDF soldiers as POWs. In a fantasy world even if they [Hamas as the terrorist body/political governing party of Gaza] were a military of a nation and declared war against Israel (unjustly), they would be required to follow the Geneva Conventions on the treatment of POWs to include reporting them to the red cross, giving the red cross access to them, and especially how their captives are treated. Everything Hamas did on October 7 (murder, rape, mutilation, kidnapping, arson, theft, etc.) was criminal and beholden to the laws of Israel. Hamas has hostages not POWs.
