Marana Unified School District’s use of school-managed Chromebooks, Google accounts and monitoring products including Gaggle, GoGuardian and Securly enables extensive surveillance of students’ digital activity both on and off campus, raising serious privacy and First Amendment concerns. Marana High School student N.M. was suspended after monitoring software captured a joke about “shoot[ing] up” the school that he typed while drafting an email at home, read to his mother, deleted and never sent or saved, despite having no disciplinary history; his family’s lawsuit, Merrill v. Marana Unified School District, challenges the district’s actions. The Supreme Court’s 2021 Mahanoy v. B.L. decision substantially limits schools’ authority over off-campus student speech, warning that regulating both on- and off-campus expression could effectively give schools control over everything students say and emphasizing schools’ responsibility to protect students’ First Amendment development. Similar monitoring has generated questionable alerts elsewhere, including Kansas students accused of uploading child pornography over fully clothed photography-class images and a student questioned after writing “I wanted to kill” in an email to her grandmother when she was referring to a fly. Constant monitoring of students’ keystrokes and private communications risks extending school authority into the home, punishing thoughts students reconsider and never communicate, undermining parental authority and normalizing government surveillance inconsistent with privacy, individual liberty and limited constitutional government.
